These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and Buzz5 d.o.o. ("Buzz5," "we," "us," or "our"), governing your access to and use of the Buzz5 platform available at buzz5.app (the "Service"). By creating an account, accessing, or using the Service in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.
If you are using the Service on behalf of a business or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, in which case "you" and "your" refer to that entity.
Buzz5 is a software-as-a-service (SaaS) review and reputation management platform designed for service businesses. The Service provides the following core capabilities:

You may not share your account credentials with third parties or allow multiple businesses to operate under one account.

Your content: You retain full ownership of all data, content, customer information, and business data you upload, create, or transmit through the Service ("Your Content"). We do not claim any intellectual property rights over Your Content. We only access and process Your Content as necessary to provide, maintain, and improve the Service, as described in our Privacy Policy.
Our platform: The Service, including its software, design, features, documentation, logos, trademarks, and all related intellectual property, is and remains the exclusive property of Buzz5 d.o.o. These Terms do not grant you any right, title, or interest in the Service beyond the limited right to use it in accordance with these Terms.
License to use: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes during your subscription period.
The Service uses artificial intelligence (powered by third-party AI providers, including OpenAI) to generate aftercare message content, including personalized greetings, care tips, follow-up suggestions, and review prompts. You acknowledge and agree that:
Free trial: Buzz5 may offer a free trial period during which you can use the Service with certain feature or usage limitations. The duration and terms of the free trial will be communicated at the time of registration. When your trial period expires, you must subscribe to a paid plan to continue using the Service. We reserve the right to modify or discontinue the free trial at any time.
Subscription billing: Paid subscriptions are billed in advance on a recurring basis (monthly or annually, depending on the plan you select). All payments are processed securely through Stripe. By subscribing, you authorize Buzz5 to charge your payment method on file for all applicable subscription fees.
Price changes: We may change subscription prices from time to time. We will notify you at least 30 days in advance of any price increase. The new price will take effect at the start of your next billing cycle following the notice period.
Cancellation: You may cancel your subscription at any time through your account settings or by contacting us. Cancellation will take effect at the end of the current billing period. You will retain access to the Service until the end of that period. No partial refunds will be issued for unused portions of a billing period.
Failed payments: If a payment fails, we will attempt to charge your payment method again and notify you of the failure. If payment remains unsuccessful after a reasonable number of attempts, we may suspend or downgrade your account until the outstanding balance is resolved.
Your privacy matters to us. Our collection, use, and protection of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in our Privacy Policy.
With respect to the customer data you process through the Service, you act as the data controller and Buzz5 acts as the data processor under applicable data protection laws (including GDPR). You are responsible for ensuring that you have a lawful basis for processing your customers' personal data and that your use of the Service complies with your obligations as a data controller.
We implement appropriate technical and organizational measures to protect the data processed through the Service. However, no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security of your data.
To the maximum extent permitted by applicable law:
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, gross negligence, or willful misconduct.
You agree to indemnify, defend, and hold harmless Buzz5 d.o.o., its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation, including anti-spam and data protection laws; (d) your infringement of any third-party rights; or (e) any messages or content you send through the Service, including AI-generated content that you reviewed, approved, and sent to your customers.
Termination by you: You may terminate your account at any time by canceling your subscription and contacting us at info@buzz5.app. Your access will continue until the end of your current billing period.
Termination by Buzz5: We may suspend or terminate your access to the Service immediately and without prior notice if: (a) you materially breach these Terms; (b) you engage in fraudulent, abusive, or illegal activity; or (c) your continued use poses a risk to the Service, other users, or third parties. For non-material breaches, we will provide reasonable notice and an opportunity to cure the breach before termination.
Data retention after termination: Upon termination, we will retain your data for a period of 30 days to allow you to export it. After this period, your data will be permanently deleted from our active systems. Some data may be retained in encrypted backups for a limited additional period as part of our standard backup procedures, after which it will also be deleted.
Termination does not relieve you of any obligations to pay fees incurred before termination. Sections of these Terms that by their nature should survive termination (including, without limitation, Intellectual Property, AI-Generated Content, Limitation of Liability, Indemnification, and Governing Law) shall survive termination.
These Terms shall be governed by and construed in accordance with the laws of the Republic of Slovenia, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the competent courts in Ljubljana, Slovenia.
If you are located within the European Union, nothing in these Terms affects your rights as a consumer under mandatory provisions of the law of your country of residence. You may also be entitled to use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
We may update or modify these Terms from time to time to reflect changes in the Service, legal requirements, or business practices. When we make material changes, we will notify you by email to the address associated with your account and/or through a prominent notice within the Service at least 15 days before the changes take effect. The "Last updated" date at the top of this page will be revised accordingly. Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and terminate your account.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect, and the invalidity of any single provision shall not affect the validity of the remaining Terms.
